Man Sues British Airways for Seat Next to Large Passenger

British Airways was hit by a lawsuit from a passenger who claimed to suffer personal injury and loss of earnings after being seated next to an “extremely large” passenger on a 12-hour flight from Bangkok (BKK) to London (LHR) in January 2016.

In the suit, 51-year-old Stephen Prosser is seeking £10,000 ($12,825), claiming the incident left him with continual back spasms and injury to his sacroiliac joint, plus aggravation to a 12-year-old spine injury.

The passenger claims the back pain left him with low energy, affecting his relationship with his partner and forcing him to stop mountain biking. Prosser, who is 5’3”, was seated next to late New Zealand rugby player Jonah Lomu, describing him as 6’4″ and more than 300 pounds.

“He was that large that he had to force his buttocks between the armrests of the seats,” said Prosser. “He sat with his knees wedged against the seat in front and the rest of his body was over spilling into my seat by some inches.

“I was immediately aware that this was going to be problematic for me and I could feel the weight of his pure bulk putting lateral pressure on my upper body. This forced me into a position of unnatural posture. Due to the size of him when he placed his arm down at times it would rest on my armrest and he would accidentally turn the volume of my audio up to an extremely loud volume each time.”

Prosser says he complained, but there were no other seats available. The airline disputes his claims, saying he was asleep at times and didn’t appear to be in discomfort.
